A legal code in a complex society is designed to have several functions. First, it is designed to announce beforehand the rules by which citizens must conduct themselves, on pain of criminal punishment. Second, if a person violates one of these rules of conduct, the criminal law must determine whether the violator is to be held criminally liable. Third, another part of its adjudicatory function, where liability is imposed the law must determine the general range, or “grade,” of punishment to be imposed. It is the first function that is of interest to us here, the socalled ex ante function of the criminal law. The code announces in advance what actions count as criminal; thus the citizenry can use the announcement to guide their actions to avoid criminal conduct. The law, in other words, draws “bright lines” between allowable and unallowable conduct, and those lines enable the citizens to regulate their conduct so they do not break the laws. To use a familiar metaphor, the criminal law specifies what sorts of actions are “out of bounds,” and the penalties for those actions, so the players will “stay in bounds.” The criminal justice system relies on people knowing the law and knowing where the boundaries for their conduct lie. Ignorance does not excuse unlawful conduct, a fact summarized in the phrase “ignorance of the law is no excuse.” Such a rule is defended as a useful means of creating an incentive for citizens to learn the law. Citizens need to know these codes if these laws are to function successfully in an ex ante mode. If, for instance, the code requires that a person who is aware of the location of a felon report that location to the police, people need to know that the code requires such conduct. If the code requires that a person help another person whose life is in danger, then for the code to guide the behavior of the potential rescuer, he or she has to be aware that the code requires that helping action.

When might an energy-efficient building be not so energy efficient? The answer revolves around location, location, location, So far, so good. But if cars area measure of pollution, that exurban location demands a bit of scrutiny. Suppose the site adds 10 miles each way to the average employees commute. Again using EPA numbers, those extra miles essentially neutralize the pollution gains from energy efficiency. If the extra commute were longer still, this energy-efficient headquarters of a socially conscious corporation would have to be ranked below average from the perspective of global climate change. Theres another way to look at it. A building thats an energy hog might actually be a better overall performer if it happens to be located adjacent to mass transit that employees use.

CONSTRUCTIONFor those companies that decide to expand via new construction, the experience can be an unsettling one, full of uncertainties. In fact, relatively few startup businesses choose construction as their mode of entry due to the higher costs associated with it and the greater length of time involved from the breaking ground stage to the day when the establishment opens its doors for business. Small- and mid-sized businesses, however, are far more likely to have the financial wherewithal to launch a new construction project. Such firms have a proven track recordwhich can help them with financingand already-productive operations that bring in revenue that can be used to defray the costs of construction.Owners of these businesses, however, should fully weigh the advantages and disadvantages of construction before moving forward. As the J.K. Lasser Institute indicated in How to Run a Small Business, Building has the advantage of giving you the space and arrangements which meet your needs, providing you know specifically and objectively what the needs are. The obvious disadvantages are the delay in occupancy while land acquisition, design work, and building are going on, and the cost of overruns and mistakes caused by forecasting errors and planning oversights.
Data for June and July show the first signs of softening in the construction sector. According to seasonally adjusted data, the value of construction put in place in July was approximately at the same level as in June and thus 7.4% lower than in May. In the five months to May, the value of construction put in place was 38.7% higher than a year ago; in June and July the difference narrowed to 16.7%. Employment in the construction sector continued to rise. In 2006, the number of workers employed in the construction sector was 7.5% higher than in the previous year. In the first seven months of 2007 it surged by 11%. The hiring of foreign workers has also been on the increase (see SEM 7/2007: 11). The number of workers rose particularly in building completion and general construction, similarly as last year. In terms of worker status, sole proprietors and their employees recorded higher growth rates. Increasingly many firms face difficulties in finding labour. According to business trends in construction, 51% of construction firms reported “a shortage of skilled labour” as a limiting factor to production. If answers are weighted by the number of employees, this share is even higher (58%) - the highest in five years (since these data have been available). The shortage of skilled workers became a significant limiting factor in the second half of 2006 (see graph), coinciding with the boom in construction activity in that period.
After the robust growth in 2006, construction activity posted even higher growth rates in 2007. The value of construction put in place surged by 18.5% over 2006. Activity in civil engineering increased by 24.7% as a result of the construction of transport infrastructure. The construction of buildings grew by 15.5%; within that, non-residential construction was up 20.2%, whereas activity in residential construction decreased by 0.9%. Based on detailed data on issued building permits, the vigorous construction of hotels appears to have continued last year, probably along with the construction of wholesale and retail trade buildings. In interpreting the figure on the value of residential construction put in place we should bear in mind that these figures exclude the activity of smaller firms (see the note under the table), where the construction of buildings is the main activity. Stronger growth was partly linked to favourable weather conditions, especially in the first half of the year. This is corroborated by the business trends regarding the limiting factors in construction. The share of firms that reported bad weather conditions as a limiting factor was much lower in the first half of 2007 than in the previous year. The weather was also more propitious than the year before in the third quarter, but it was less favourable in the fourth quarter, which affected growth in the latter part of the year. The growth in the number of employees increased further last year. In 2007 the number of people employed in the construction sector was 11.3% higher, on average, than in 2006. The number of workers by activity rose particularly in building completion; in the latter part of the year it also increased in general construction. In terms of employee status, higher growth rates were recorded in the number of sole proprietors and their employees.

If you are a school leader in one of the rare districts whose state legislature decided this summer to support quality education with adequate funding for all your schools, the future must look bright, so you can skip the remainder of this column. The Coastal Commissions ability to prevent development by designating environmentally sensitive habitat areas appears to depend on the existence of a certified local coastal program (LCP). However, in a case from Los Angeles County, the Second District Court of Appeal ruled that the Commission could reject a landowners coastal development permit in part because the site is not covered by a certified LCP. When there is no LCP, the commission is given wide latitude to examine conformity with all Coastal Act policies, the court ruled. The Sand City case involves a controversy with more than 20 years of history. The Lonestar Company closed its sand mine, located between Highway 1 and the ocean in Sand City, in 1986. That same year, the Commission certified Snad Citys LCP that designated the 39-acre sand mine site for visitor-serving commercial uses.

Monday May 5, 2003 will go down in history as a day to remember in employment law. It was the day the long-debated amendments to the Health Safety in Employment Act finally came into effect. Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

Three days after furniture-makers filed a petition seeking the imposition of antidumping duties of Chinese wood bedroom furniture, the CEO of Furniture Brands International, one of Americas largest furniture manufacturers, vowed to fight against it. Joe Dorn, of the Washington, DC, law firm King Spalding, represents the coalition and union. The day of the filing, Dorn said, The petition presents very compelling evidence of the serious injury suffered by the U.S. wood bedroom industry and its workers from a surge of unfairly priced imports from China. The petition states, Dumped imports were equal to 44 percent of the value of domestic production and 23 percent of the value of apparent domestic consumption in 2002. During January to June 2003, it says, dumped imports were equal to 67 percent of domestic production and 30 percent of apparent consumption. It also contends (The) petitioners net sales value decreased by 23 percent from 2000 to 2002, and by another 24 percent from the periods January to June 2002 (and) January to June 2003.
MFI YESTERDAY blamed a dire end to its key winter sale for plunging like-for-like sales at its core UK retail business. The furniture group, which just three weeks ago guided the market to expect sales to recover, said its “outdated” bedroom ranges had put customers off buying its products. Its shares plunged 3 per cent to 140p. Like-for-like sales across its UK estate fell by 4 per cent from Boxing Day to 21 March, exacerbating the 3 per cent decline that the group reported last month. David Jeary, at Credit Suisse First Boston, said same-store sales must have fallen by 6 to 7 per cent in March, against the managements hopes that they would be flat against the previous year.

John and Wendy Cornwall begin the essays by outlining what they call an “evolutionary-Keynesian” analysis of capitalist performance (p. 11). They correctly note that economic change cannot be adequately analyzed within the neoclassical framework, which assumes a self-regulating system always tending toward a full-employment equilibrium. Their alternative stresses aggregate demand and its institutional determinants. It also stresses endogenous structural change and the impact of history upon capitalist development. Although the Cornwalls approach is promising, their brief description of how this applies to advanced capitalist nations is somewhat disappointing. Their explanation for the demise of the postwar “golden age” of high employment stresses both a wage-determination system driven by unions exercise of market power and the rise of labor militancy in the late 1960s and early 1970s; it is neither new1 nor convincing. A more comprehensive application of the evolutionary-Keynesian approach seems warranted, one bringing attention to other factors including corporate businesses practices, the rise of global competition, and the spread of financial fragility.

Political Economy of Money and Finance Macmillan, London; and St. Martins Press, New York, 1999. This is an exceedingly important book. it is probably the most important contribution to the Marxian theory of money, credit and finance to appear in English since the translation of Suzanne de Brunhoffs Marx on Money in 1976. Itoh and Lapavitsas book includes a wealth of information, superb literature reviews, profound analyses of the historical evidence and substantiated discussions of controversial policy issues, whose digestion will keep even the most demanding readers busy for a long time. Their argument is invariably thorough, and their research ranges widely, and admirably, from the logical and historical origins of money to free banking, and from long wave theories to socialist money. In spite of its virtues, and partly because of them, this book will probably not become an icon of the literature, although it will certainly become a major reference in the field (which may well be a better option). The reason is simple: Itoh and Lapavitsas probe very deeply into Marxs theory of money and credit, marshal evidence widely, and engage in a wide variety of debates, not least with Marx himself (eg., they criticise certain aspects of Marxs theory of money, on pp.37-40, and credit, on pp.64-5). As their work is very ambitious, complex and controversial, it is unlikely to be universally acclaimed.

Im not a big fan of firearm lanyards. Yes, I thought they were pretty cool when the Marines first issued me one in 1964, but the cool factor only applied to the way they looked, not the way they worked. As long as I didnt actually have to draw my 1911, the lanyard worked fine, and it did look cool. However, once the pistol was drawn, the lanyard became a big pain in the six oclock. It snagged on everything and got in the way during reholstering. Now, Pistol Leash Unlimited comes to the rescue. This is a smart why didnt I think of that product. Designed by a federal agent, who I will not ID because he can and will hurt me, the Pistol Leash does what a lanyard is supposed to do: work. THE POPE has urged Roman Catholic lawyers and magistrates to refuse to handle divorce cases. He warned that divorce was “spreading like the plague” and lawyers should decline to use their profession for, “an end that is contrary to justice”. Pope John Paul II has in the past insisted that Catholic doctors not perform abortions or assist women with contraception. But this is the first time he has tried to tell the legal profession what to do. The reaction from politicians and advocates in Italy has been one of dismay at such open interference in civil issues.

UNION CITY — In the old Decoto district, excess rainwater gets whisked away in much the same way it was when railroad workers populated the neighborhood well more than a century ago: through gravity and evaporation. The district is the only one in Union City, and one of only a few in the Bay Area, that does not have rainwater drainage pipes underneath its streets. Some of the water evaporates, said Public Works Director Mintze Cheng. Other water goes downhill and eventually drains into Alameda Creek. It just takes much longer.
WASHINGTON — Concentrations of mercury in the rainwater of several southeastern and Gulf Coast states exceed the safe level established by the Environmental Protection Agency for lake water by as much as 96 times, an environmental group reported Thursday. The National Wildlife Federation said EPA mercury sampling stations in Georgia, Texas, Florida and five other Southern states showed mercury levels that would make fish toxic to humans who consumed them. The federation, largest environmental organization in the country, called on the EPA to crack down on the sources of mercury in the atmosphere, especially coal-burning electric power plants.

Lucent Technologies Microelectronics Group claims it has a better approach to the packaging of its new Firewire chip. Last week the company announced a new IEEE1394A FireWire physical layer interface (PHY) chip with a smaller footprint than similar devices on the market. The three-port, IEEE-1394-A-compliant physical layer interface IC, called FW803, is housed in a 64-pin thin quad flat pack (TQFP). The device provides a powerful combination of small size and low power that helps reduce final system costs, he said. Design engineers can use the chip to create new applications for PCs, workstations and consumer electronics; because it dissipates less than 0.6 watts during normal operation, it can further increase design options for portable PCs or other compact, battery-powered systems, Lucent noted. The chip will be sampling in June, and is expected to be generally available during 3Q98. Pricing in quantities of 10,000 will be $5 per unit. Other volume pricing options are also available.
The San Jose firm is also working with IBM and others to gain acceptance for the IBM-patented package as a JEDEC standard. This family is being registered in the JC11 JEDEC committee at this present time. I am certain it will be fully registered in 1995, if not in the December (1994) meeting, said Dick Groover, VLSIs director of Package Development. Other companies are expected to introduce TBGA packaging in the near future. Sources close to LSI Logic said that company and at least one Japanese vendor are planning to offer TBGA packaging. We have delivered 552-pin TBGA-packaged devices to our customers and are planning to roll out more members of the family by the end of 1994, said Herb Reiter, VLSIs director of ASIC Product Planning. This complements what we are doing on the silicon end. We are at an average complexity of 125,000 gates. TBGA, which accommodates 1/2 million to 3/4 million gates, will easily accommodate our top 10 customers. VLSI paid a one-time license fee - amount undisclosed - to IBM for use of the TBGA technology, and then built custom packages around that to accommodate the needs of its customers. TBGA packages offer up to 672 pins, and are able to accommodate more than one-half million gates at clock frequencies beyond 15OMHz. VLSI will offer the packages with its cell-based and gate array designs implemented in 0.5- or 0.6-micron CMOS technology. Targets for the package include cost-sensitive, high integration applications such as workstations, supercomputers, parallel computing, networking, transmission and digital television systems.
Vicor Corp. has licensed its patented reset technology and related know-how in its power conversion products to Nagano Japan Radio Co., Ltd. (NJRC), a subsidiary of Japan Radio Co., Ltd. (JRC). The agreement gives NJRC nonexclusive rights to use Vicors products. Under the patents license agreement, NJRC is granted worldwide rights to manufacture, use and sell standard, custom and high-density DC-DC converter products which incorporate technology covered by Vicors reset patents. Vicors reset technology, also called active clamp technology, enables design of zero-voltage switching power converters which are smaller and more energy efficient than conventional power supplies. NJRC has also entered into a know-how agreement under which it acquires non-exclusive rights to, and training in, Vicors know-how with respect to the reset technology. NJRC designs, develops and manufactures power supplies, radio communication equipment, office automation and other electronic equipment, and electronic components and sensors, and is headquartered in Nagano, Japan. The Panda Project Inc. will work with Chip Supply Inc. for product support and marketing of Pandas PQFP-B semiconductor package, VSPA. Chip Supply is a privately owned company located in Orlando, Fla. and is the premier semiconductor die distributor and value-added die processor. The target customer market includes high-reliability aerospace, military, medical, industrial and commercial systems. Panda and Chip Supply will cooperate in marketing and final assembly of VSPA packages and known good die to provide high value solutions to the electronics industry. Initial projects include work on Sharps DSP-9142 chip, Cyrixs 6×86MX chip and Motorolas PowerPC chip. Chip Supply will provide assembly and testing of its die and interface with its customer base on both single and multichip modules. Chip Supply will also be qualified to handle production orders for VSPA as a Certified Assembly Center. With the access to the die at Chip Supply, and Pandas expertise with both systems level design and an intimate knowledge of VSPA, the results could be very interesting, said Stanford W. Crane Jr., president and CEO of Panda. Nanopierce Technologies Inc. announced it will acquire San Diego, Calif.-based Sigma 7 Corp., which manufactures advanced memory solutions for the PC market and commercial and industrial applications. Intercell Corp. currently owns Sigma 7. The deal is expected to be complete before the end of this month, the companies said. Paul H. Metzinger, president and CEO of Nanopierce, said this acquisition makes Nanopierce a revenue-generating company and enhances Nanopierce Particle Technology. Following a recapitalization of Sigma, Nanopierce will issue approximately 2,500,000 of its restricted common shares to the common shareholders of Sigma, and Series B Convertible Preferred shares, convertible into at least 6,500,000 common shares at $0.70 per share, to Intercell Corporation. The transaction is valued at approximately $11,000,000. After closing, Nanopierce will have 14,600,000 common shares outstanding. Sholom Zuckerbrot Realty LLC (SZ) has negotiated a 9,000 s/f lease for the studio at 33-06 37th Avenue, announces SZ chairman Sanford Zuckerbrot. When Rocket Rehearsals Manhattan landlord decided to convert the four-story walk-up industrial building on West 36th Street into a residential property, the firm set its sights on a clean, high ceiling, one-story facility in Long Island City, said SZ managing director Joseph Eliasoph, who represented the tenant.
A couple of weeks ago I entered a recording studio. I havent been in one of those facilities since 1985. It was both nostalgic and new at the same time. The last time I was in a studio there was no such thing as the digital recording program Pro Tools, which is used in all types of professional-recording sessions.

John Osbornes first play, Look Back in Anger, had its premiere in 1956 and he called it a formal, old-fashioned play. His second play, The Entertainer, was set during the Suez Crisis and opened in 1957. What was new about both was that the characters were real working-class people. No real parts had been written about working- class characters before - only “cheeky chappy” roles such as Doolittle in Pygmalion. When asked if I wanted to go to see The Entertainer I was uncertain. Why? I had worked backstage on a brilliant amateur production (by the Tavistock Rep) in 1969 and it had stayed in my mind, with few productions since to affect the fond memories. How wrong I was to hesitate. For me this production, under Sean Holmess direction, ticks all the boxes and putting it on 50 years after it was set is brilliant timing. So much of it resonates in 2007: a misguided war in the Middle East and young men dying needlessly; the obsession with skinny/size zero women; fading performers (or “personalities”) trying to reinvent themselves; feelings against politicians of either party; comments about the Poles and the Irish; and confusion over national identity.
This may be an unpopular position to adopt, but some of us are going to miss him, you know. Of course were aware of his disadvantages - hes got a bit of an obsession with abroad, for example, whether for holidays or invading - but you have only to clock his easy way with the bag containing his Fender Stratocaster to know this is a born entertainer. And he has brought his own unique gifts, whether showing the touch of a Sinatra over his retirement, the ease with a catchphrase - “pretty straight kind of guy”, “45 minutes”, “peerage?” - or the mastery of the telling, colourful and often intriguingly vague detail, whether it be working as a waiter in Paris, or his earlier bid for a free holiday when, as a teenager, he tried to stow away on a jet bound for the Bahamas. Such things cling to him. Fine details around the Miami trip include the hairy landing; the 24 imported privacy protecting palm trees; jamming with the Gibbs; the suggestion that Mrs Gibb, as a bisexual druid, disapproves of tennis, and now, the quiet (presumably in deference to Mrs Gibb) mass in ritzy Palm Beach, complete with Aston Martin. Come on: didnt you also feel an unworthy tinge of regret at promises from the Brown camp of a “humbler”, less showy premiership?

THEY HAVE banned television, video cassette recorders, cameras, chess, homing pigeons, fighting partridges, short beards and long hair (for men). They have outlawed brown paper bags (in case they were manufactured from pages from the Koran), white socks for women, and all musical instruments except the tambourine. The initiative sent prices of leather jackets in the Afghan capitals markets tumbling from 1.6 million Afghanis (pounds 23) to 1.2 million Afghanis. A despondent Afghan in Kabul lamented: “They will be ordering us to throw away our shoes next.” Leather jackets are perceived as a powerful symbol of Westernisation. Perhaps the young Taliban, whose notion of chic consists of layers of flowing cotton, simply felt intimidated by the citys youth, and took steps to put it right.
The enduring love affair with the aviators best friend As the war clouds of WW I loomed on the horizon, aviators did not have special flight clothing and typically flew with whatever uniform was prescribed as the uniform of the day. Throughout the worlds air forces, this widespread practice dates back to the origins of flight when Orville and Wilbur Wright flew their Flyer in their suits; WW I aviators flew in their service dress jackets with “choker”-style collars. It was no wonder that silk scarves were introduced to protect necks from chafing. The common day suit of the time sufficed for the early flights of limited duration, speed and altitude. As speeds increased and aircraft pushed ever higher for longer flights, aviating became progressively more inhospitable owing to wind blast and the cold temperatures at altitude. Aviators turned to the only available sources of robust protective clothing: sports equipment suppliers and “outfitters,” whose tailors had produced specialized clothing for years for use by expeditions venturing into the Arctic cold and the high altitudes of unconquered summits. One of these firms, Willis and Geiger, is credited with developing the G-1 design for the Navy. It is still in existence. Auto racing, which had a slight lead on aviation, and the fledgling game of football, had encouraged sports suppliers into the development of protective helmets that aviators adapted for their use. Aviators still had to improvise until aviation became widely accepted. LAWYERS who had wanted General Pinochet extradited were still trying early last week to decide what “legal steps” they could take to stop him going to Chile. For some reason I found myself thinking of the sad advertisements one used to see occasionally in the personal columns: “Public school man seeks interesting job, anything legal considered.” But of course I was confusing two different functions of the word legal. Ethical began by meaning “to do with ethics”, and only later came to mean being good. The purist in me still winces when someone says “aesthetic” when they mean “in good taste”. (Aesthetic originally meant “to do with the science of perception”, then “to do with taste”, good, bad or indifferent.) But there was never any need for legal to carry two meanings, because theres a perfectly good alternative that takes half the burden off it: lawful, a nice old word from the late Middle Ages (its parent word, law, appears to be of ancient Scandinavian origin). Everyone understands the difference between “legal business” and the “lawful business” that most of us spend our lives going about. Why couldnt those job-seekers have put “anything lawful considered”? Lawyers use lawful, too; they speak of a “lawful killing”. They dont say “a legal killing” (which, if it meant anything, would presumably refer to their fees).
They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

In 1993, equipment leasing grew about 3 percent, a little better than 1992s growth, but still modest by historic standards. Expansion was hindered by the economys sluggish performance (see Trends and Forecasts for Equipment Leasing table). Leasing is a financial mechanism involved in about 32 percent of private, nonresidential purchases of producers durable equipment; the percentage has been relatively constant for the last several years. In 1992, according to an industry survey, growth in leasing was led by containers, with a 150 percent increase over the previous year. Furniture, fixtures, and equipment was second with a 100 percent increase, while materials handling increased 60 percent. Computers replaced aircraft as the largest leasing sector in 1992, following a 33 percent plunge in aircraft leasing because of commercial airlines economic difficulties (Table 1). According to the U.S. Department of Commerce, 80 percent of all U.S. companies lease all or some of their equipment. Most established businesses prefer leasing to avoid technical obsolescence without overspending. According to the Equipment Leasing Association of America (ELA), 77 percent of all leased high-tech equipment in the computer industry is either replaced or upgraded within 24 months.Greg Loeschke of Farm Credit Leasing in Minneapolis advises customers not to confuse loans with leases. A loan requires a [company] to invest a down payment in the equipment, or a first-and-last payment, and to finance the remaining amount, whereas a lease requires no down payment and finances only the value of the equipment expected to be depleted during the lease term, he says. Securing a loan usually requires the borrower to pledge other assets for collateral, while collateral is usually not needed to secure a lease.
EQUIPMENT LEASINGThe two primary types of leases are operating leases and long-term leases. Operating leases are characterized by short-term, cancelable terms, and the lessor bears the risk of obsolescence. These leases are generally preferable when the company needing the equipment needs it only for a short period of time. Under the usual terms of such agreements, a lessee can usually cancel an operating lease, assuming prior notice, without a major penalty. Long-term, noncancelable leases, which are also known as capital, full payout, or financial leases, are sources of financing for assets the lessee company wants to acquire and use for longer periods of time. Most financial leases are net leases, meaning that the lessee is responsible for maintaining and insuring the asset and paying all property taxes, if applicable. Financial leases are often used by businesses for expensive capital equipment.
